Contractual confidentiality

Information shared by a client during an engagement is held in confidence under the terms of the written engagement agreement. This firm does not disclose client information to third parties without the client's consent, except as required by law.

Confidentiality is not privilege

Unlike attorney-client communications, which are protected by legal privilege, information shared with a consultant or advisor is generally discoverable in legal proceedings. Confidentiality is a contractual obligation, not a legal privilege. This means that a court or regulatory authority may compel disclosure of information that a client shared in confidence.

What this means for you

Before sharing sensitive information, understand the distinction. If you are involved in or anticipate litigation, discuss with your attorney what information should and should not be shared with outside advisors. This firm will cooperate with lawful legal process.

Tax return information

Tax return information is protected by IRC §7216, which makes unauthorized disclosure or use of tax return information a criminal offense. Tax return information is used solely to prepare your return and is not disclosed or used for any other purpose without your prior written consent in the specific statutory form required.

Protected health information

Secure channels

Confidential information is exchanged only through secured channels established under a written agreement a secure client portal, not email or website forms. Do not send sensitive information through this website's forms or by email.
